Management, Control and Compliance
Practical Application of the General Data Protection Regulation
Businesses today face a significant challenge regarding the protection of natural persons against the processing of personal data.
A company, in addition to developing a Privacy Policy, must have its Marketing, Sales, Service, HR and other operations activities harmonized and aligned with the GDPR regulation (EU) 2016/679 of the European Parliament and of the Council.
The company's communication with existing and potential customers, staff, partners and other persons is done using personal data. Thus, the need arises for the business to ensure and be able to prove its compliance with the GDPR protecting it from legal consequences and dragging its reputation.
The PD Commissioner's Office, in case of non-compliance, may impose an administrative fine of up to 10,000,000 euros or 2% of the total annual turnover, whichever is greater, and in case of non-disclosure of a data breach, the administrative fine may be up to 20,000,000 euros or 4 % of total annual turnover. Also, a company's reputation can be tarnished to the extent that it can even be destroyed.
According to the announcement on 13/07/2020 on the website of the Office of the Commissioner of the MFDS, the implementation of compliance checks has begun, including through e-mail with the completion of a special questionnaire that is part of the audit documentation. The largest fine imposed until 01/2020 is 82,000 euros to a company as an employer.
Trust is the most important asset for a business since it can determine its value. A business that develops a comprehensive data protection system ensures a higher level of trust shown by the involved stakeholders - customers, staff, partners and other persons as well as relevant regulatory authorities.
